These Terms form a legally binding agreement between you and Tessovate Technologies Pvt Ltd ("Nishu Digital", "we", "us"), the operator of www.nishu.digital. By using the website or placing an order you agree to them. If you do not agree, please do not use the website.
1. About us
Nishu Digital is a brand of Tessovate Technologies Pvt Ltd, a company incorporated in India with its office at Tessovate technologies, Kariyangala Village Polali Post, Bantwala, D.K, 574219 (GSTIN: …). We sell ready-to-buy digital services, software set-up, customisation and related digital products.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract under the Indian Contract Act, 1872.
- If you order on behalf of a business, you confirm you are authorised to bind that business.
- You must give accurate billing and contact details. We may refuse or cancel orders placed with false or incomplete information.
3. Services and scope
- Each product page describes what is included. Anything not listed there is outside the scope of the order and may be quoted separately.
- Hourly services are billed for the hours or package you select. If more time is needed, we will tell you before doing extra work.
- Some services depend on third-party platforms (for example Meta/WhatsApp, Google, hosting providers, ClientExec, WordPress). Their approval, availability, policies and fees are outside our control, and they may change at any time.
- We do not guarantee specific business results such as rankings, leads, sales or approval by a third-party platform unless a guarantee is stated in writing for that order.
4. Orders and pricing
- Prices are shown in USD and/or INR. Online payments are charged in the currency shown at checkout. Conversions shown on the site are for reference.
- Applicable taxes, including GST at the prevailing rate for Indian customers, are added at checkout and shown on your receipt.
- An order is confirmed only when payment succeeds and you receive our confirmation email or receipt.
- We may correct obvious pricing errors. If an error affects your order, we will contact you and you may cancel for a full refund.
- Coupon codes are subject to their stated terms, cannot be exchanged for cash, and may be withdrawn at any time.
5. Payments
Payments are processed by Razorpay Software Pvt Ltd using UPI, cards, netbanking and wallets. We do not see or store your full card details. You can also pay quotes and invoices through our payment link at https://razorpay.me/@nishudigital. You agree to Razorpay's terms when you pay through it.
6. Your responsibilities
- Give us timely access, content, credentials and approvals needed to deliver the service. Delays on your side can extend delivery timelines.
- Make sure you own, or have permission to use, all content, trademarks and data you share with us.
- Keep backups of your website, data and systems before work begins, unless backup is part of the service.
- Follow our Acceptable Use Policy.
7. Delivery and acceptance
Delivery timelines are estimates. They start once we have payment and everything we need from you; see our Shipping & Delivery Policy. A deliverable is treated as accepted if you do not report a material defect within 14 days of delivery. We will fix reported defects that are within scope at no extra cost.
8. Cancellations and refunds
Cancellations and refunds are governed by our Refund & Returns Policy.
9. Intellectual property
- Once you pay in full, you own the custom deliverables we create specifically for you, except for the items below.
- We keep ownership of our pre-existing tools, code libraries, templates and know-how. You get a non-exclusive licence to use them as part of the deliverable.
- Third-party software, themes, plugins, fonts and images are licensed under their own terms, which you must follow.
- Unless you ask us not to, we may mention your business name and a description of the work in our portfolio.
10. Confidentiality
Both parties will keep each other's non-public information, including credentials, confidential and use it only to perform the order. We recommend changing any passwords you shared with us once the work is complete.
11. Warranties and limitation of liability
- We perform services with reasonable skill and care. Apart from that, the website and services are provided "as is" to the extent allowed by law.
- We are not liable for indirect, incidental or consequential losses, including loss of profit, data, revenue or goodwill.
- Our total liability for any claim relating to an order is limited to the amount you paid for that order.
- Nothing in these Terms limits liability that cannot be limited under Indian law.
12. Indemnity
You agree to compensate us for third-party claims that arise from content or materials you supplied, or from your breach of these Terms or the Acceptable Use Policy.
13. Suspension and termination
We may suspend or stop work if you breach these Terms or the Acceptable Use Policy, if payment fails or is reversed, or if continuing would break the law. Amounts for work already done remain payable.
14. Governing law and disputes
These Terms are governed by the laws of India. We will first try to resolve any dispute amicably; please contact us first. Unresolved disputes fall under the exclusive jurisdiction of the courts at Mangaluru, Karnataka, India.
15. Changes to these Terms
We may update these Terms from time to time. The version in force when you place an order applies to that order. The "Last updated" date above shows the latest version.
